Mathonaut — Terms of Service

These Terms of Service govern your use of Mathonaut, an application published by Bystronaut. By downloading or using the app, you agree to these terms.

1. Who we are

Mathonaut is developed and published by Michał Mączka, operating as Bystronaut, a sole-trader software studio based in Switzerland. Contact: mathonaut.app@gmail.com.

This agreement is between you and Bystronaut. Apple Inc. and Google LLC are not parties to this agreement and are not responsible for Mathonaut or its content.

2. The app

Mathonaut is a mental math trainer for mobile devices. It is available on the Apple App Store and Google Play. Features described in the app or its store listings are subject to change as we improve the product.

3. License to use

Bystronaut grants you a personal, non-exclusive, non-transferable, revocable licence to use Mathonaut on devices you own or control, solely for your own non-commercial purposes, in accordance with these terms and the rules of the app store from which you downloaded it. You may not sublicence the app or use it on behalf of any third party for commercial purposes.

4. Mathonaut Pro subscription

Mathonaut offers an optional paid subscription called Mathonaut Pro that unlocks additional content and modes.

6. Intellectual property

All content, design, graphics, and code in Mathonaut are the property of Bystronaut and are protected by applicable intellectual property laws. Nothing in these terms transfers any ownership rights to you.

7. No warranty

Mathonaut is provided "as is" without warranty of any kind. Bystronaut makes no guarantees that the app will be error-free, uninterrupted, or suitable for any particular educational purpose. Your use of the app is at your own risk. To the extent mandatory consumer protection laws in your jurisdiction imply warranties that cannot be excluded, those warranties remain in force.

8. Maintenance and support

Bystronaut, not Apple or Google, is responsible for any maintenance and support of Mathonaut. Contact us at mathonaut.app@gmail.com for support. Apple and Google have no obligation to provide any maintenance or support for the app.

9. Limitation of liability

To the fullest extent permitted by law, Bystronaut shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of — or inability to use — Mathonaut. In any case, our total liability to you shall not exceed the amount you paid for Mathonaut Pro in the twelve months preceding the claim.

Nothing in these terms excludes or limits Bystronaut's liability for fraud, fraudulent misrepresentation, gross negligence, death or personal injury caused by our negligence, or any other liability that cannot be excluded or limited by applicable law, including mandatory consumer protection rights in your jurisdiction.

10. Third-party beneficiary

Apple Inc. is a third-party beneficiary of these terms for Mathonaut distributed through the Apple App Store. Upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary. Google LLC has a similar right for distribution through Google Play.

11. Intellectual property claims

Bystronaut, not Apple or Google, is responsible for the investigation, defence, settlement, and discharge of any third-party intellectual property infringement claim related to Mathonaut.

12. Export compliance

You represent and warrant that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. government list of prohibited or restricted parties.

13. Children

Mathonaut is intended for use by children under the supervision of a parent or guardian. Parents and guardians are responsible for supervising their child's use of the app, including any in-app purchases, and should review our Privacy Policy. We do not knowingly collect personal information from children within the meaning of COPPA or GDPR.

14. Changes to these terms

We may update these terms from time to time. We will revise the date at the top of this page when we do. Continued use of the app after changes constitutes acceptance of the updated terms.

15. Governing law

These terms are governed by the laws of Switzerland, without regard to conflict-of-law rules. Any disputes shall be resolved by the competent courts of Switzerland, except where mandatory consumer protection laws in your country of residence give you the right to bring proceedings in your local courts, which we will not seek to override.
